亂象:由于旅游者和旅游組織機(jī)構(gòu)安全意識淡漠,缺乏應(yīng)有的素質(zhì),違反操作規(guī)程或不遵守操作規(guī)程;或者因只注重經(jīng)濟(jì)效益,提供不合格的旅游產(chǎn)品,從而引發(fā)旅游安全事故,造成旅游者人身和財產(chǎn)安全受到侵害。 | Phenomenon: Due to the fact that some tourists and tourism organizations have low safety awareness, lack relevant knowledge and qualities, violate relevant regulations or pay attention to only the economic benefit and offer disqualified tourism products, tourism accidents often occur, injuring tourists and leading to their economic losses. |
案例:2012年3月,兩名“驢友”相約攀爬北京房山區(qū)周口店鳳凰山,不慎失足墜崖。歷時10個多小時的救援,在周口店青銀溝解救一名生還者,另一人在救援人員找到時已經(jīng)身亡。2009年,華北電力大學(xué)周副教授在鳳凰嶺公園爬山,不幸墜崖殞命。法院判決認(rèn)定因周副教授自行爬野山導(dǎo)致死亡,鳳凰嶺公園不承擔(dān)過錯賠償責(zé)任。 | Case: In March 2012, when two travelers were climbing Fenghuang Hill in Zhoukoudian, Fangshan District, Beijing, they fell off a cliff. Rescuers, after searching for them for more than 10 hours, found a survivor in Qingyin Valley, Zhoukoudian, but the other one was already dead when they found him. In 2009, an associate professor from North China Electric Power University Zhou also fell off a cliff and lost his life while climbing a hill in Fenghuang Ridge Park. The court judged that Zhou's death was caused by his own action and Fenghuang Ridge Park was not responsible for it. |
草案規(guī)定:縣級以上人民政府應(yīng)當(dāng)依法將旅游應(yīng)急管理納入政府應(yīng)急管理體系,制定應(yīng)急預(yù)案,建立旅游突發(fā)事件應(yīng)對機(jī)制。突發(fā)事件發(fā)生后,當(dāng)?shù)厝嗣裾捌溆嘘P(guān)部門和機(jī)構(gòu)應(yīng)當(dāng)采取措施開展救援,并協(xié)助旅游者返回出發(fā)地或者旅游者指定的合理地點(diǎn)。旅游者可能達(dá)到或者超過最大承載量時,景區(qū)應(yīng)向當(dāng)?shù)厝嗣裾畧蟾妫皡^(qū)和當(dāng)?shù)厝嗣裾畱?yīng)當(dāng)及時采取疏導(dǎo)、分流等措施,旅游者應(yīng)當(dāng)予以配合。 | Draft tourism law: Every people's government above the county level should bring the tourism emergency management into the governmental emergency management system according to laws, make emergency response plans and establish the tourism emergency response system.
