System of lists of government powers
Lists of government powers are those that catalogue the functions and powers of China's executive branch at different levels. These lists are available for public scrutiny.
At its Third Plenary Session in November 2013, the 18th CPC Central Committee decided to put in place a transparent system whereby the powers of local governments and their departments are catalogued so as to ensure that these powers are exercised according to the law. At its Fourth Plenary Session in October 2014, the 18th CPC Central Committee decided to further implement the transparency initiative in order to eliminate any room for personal profiteering.
This initiative is crucial to China's effort to upgrade its governance system and capacity. It is designed to ensure that no public authority exercises or assumes any power that is not granted by law.
權(quán)力清單制度
權(quán)力清單指中國(guó)各級(jí)政府根據(jù)法律法規(guī)的規(guī)定,以清單方式對(duì)政府及政府部門(mén)行使的職能、權(quán)限進(jìn)行列舉,形成行政權(quán)力事項(xiàng)目錄,對(duì)外公布并接受社會(huì)監(jiān)督。
中國(guó)共產(chǎn)黨十八屆三中全會(huì)《決定》提出,“推行地方各級(jí)政府及其工作部門(mén)權(quán)力清單制度,依法公開(kāi)權(quán)力運(yùn)行流程?!笔藢盟闹腥珪?huì)《決定》進(jìn)一步提出,“推行政府權(quán)力清單制度,堅(jiān)決消除權(quán)力設(shè)租尋租空間。”
推行權(quán)力清單制度是中國(guó)推進(jìn)國(guó)家治理體系和治理能力現(xiàn)代化的一項(xiàng)基礎(chǔ)性工作,它要求政府部門(mén)法無(wú)授權(quán)不可為,不得法外設(shè)定權(quán)力。
